Release and Waiver of Liability
I agree to the following
- I understand that I am choosing to participate in this program, during which I may receive instruction about yoga, dance, health and wellness. I recognize that yoga and dance require physical exertion that can be strenuous. I am fully aware of the risks involved.
- I understand that it is my responsibility to consult with a physician prior to and regarding my participation in this program. I represent and warrant that I am physically fit and have no medical conditions that would prevent me from participating. I assume full responsibility for any injuries or damages, known or unknown, which I might incur as a result of participating. I knowingly, voluntarily, and expressly, waive any claim I may have against Diamond Mountain and any of our teachers for injury or damages that I may sustain as a result of participating in the program.
- Diamond Mountain (DM) is a non-profit religious institution, run by a volunteer and paid staff. The use of volunteers and the opportunity to participate in the activities of DM includes but is not limited to: residing in houses, cottages, RVs, yurts, and tents, walking and driving on DMRC land, and exposure to a desert environment. This entails some greater risks to you than if you were in a urban setting, hotel, or facility. The Staff and Board of DM does everything they can to keep DM safe and comfortable for participants, volunteers, visitors, and staff members. We encourage you always to inform us of anything you see that requires attention.
HAVING CONSIDERED THE ABOVE, I FREELY ACCEPT AND VOLUNTARILY ASSUME THE RISKS OF INJURY AND RELEASE DIAMOND MOUNTAIN, ITS DIRECTORS, OFFICERS, STAFF, VOLUNTEERS, AND THEIR AGENTS FROM ANY AND ALL LIABILITY FOR PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM THE NEGLIGENT CONDITIONS OF THE PREMISES, OPERATIONS OF DIAMOND MOUNTAIN, ACTS OR OMISSIONS OF ITS STAFF OR FROM RESPONSIBILITY FOR ANY SUCH DAMAGE OR INJURY OF ANY KIND THAT MAY RESULT. I MAKE THIS WAIVER FOR ANY ACTIVITY, COURSE, RETREAT, OR PROGRAM AT DIAMOND MOUNTAIN IN WHICH I MAY PARTICIPATE, AND I INSIST THAT MY WAIVER COVER ANY CLAIM THAT MY SPOUSE AND/OR CHILDREN MAY MAKE ON MY BEHALF.
